{"id":900,"date":"2018-05-20T14:31:56","date_gmt":"2018-05-20T12:31:56","guid":{"rendered":"http:\/\/www.herald-avocats.com\/?p=900"},"modified":"2019-01-31T12:17:22","modified_gmt":"2019-01-31T11:17:22","slug":"euipo-escapes-liability-in-public-procurement-case","status":"publish","type":"post","link":"https:\/\/www.herald-avocats.com\/en\/euipo-escapes-liability-in-public-procurement-case\/","title":{"rendered":"EUIPO escapes liability in public procurement case as ECJ partially sets aside General Court judgment"},"content":{"rendered":"<h1>17EUIPO escapes liability in public procurement case as ECJ partially sets aside<br \/>\nGeneral Court judgment<\/h1>\n<p>Richard Milchior, partner and <a href=\"http:\/\/www.herald-avocats.com\/en\/avocats\/richard-milchior\/\">IP lawyer<\/a>, wrote and article for the\u00a0<a href=\"https:\/\/www.worldtrademarkreview.com\">World Trademark Review<\/a>.<\/p>\n<p>The decision of the Court of Justice of the European Union (ECJ) in <strong>European Union Intellectual Property Office v European Dynamics Luxembourg SA<\/strong> (Case C-376\/16 P, May 3 2018) confirms that the European Union Intellectual Property Office (EUIPO) <strong>may incur non-contractual liability<\/strong> in cases involving <strong>calls for tenders<\/strong> in public procurement.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Background<\/strong><\/p>\n<p>\nIn August 2011, EUIPO notified its decision in a tendering procedure entitled &#8220;Software development and maintenance services&#8221;, <strong>rejecting the tender submitted by the company European Dynamics Luxembourg<\/strong>.<\/p>\n<p>In October 2011 European Dynamics Luxembourg, European Dynamics Belgium SA and jointly interested parties\u00a0<strong>brought an action for annulment of the decisions<\/strong> at issue before the General Court.<\/p>\n<p>In support of the action before the General Court, European Dynamics and others put forward three pleas in law, alleging:<br \/>\n1. <strong>infringement<\/strong> of the <strong>duty to state reasons<\/strong>;<br \/>\n2. several <strong>manifest errors<\/strong> of assessment; and<br \/>\n3. <strong>infringement<\/strong> of the principle of <strong>equal treatment<\/strong>.<\/p>\n<p>The General Court examined the third plea in law and <strong>upheld only the third part of it<\/strong>. It considered that the <strong>EUIPO<\/strong> had clearly <strong>breached its duty of diligence<\/strong> when investigating the 2817existence of the ground for exclusion.<\/p>\n<p>The General Court also <strong>upheld a part of the second plea in law.<\/strong>\u00a0It found that the <strong>existence of manifest errors<\/strong> of assessment or inadequate reasoning that <strong>vitiated the lawfulness of the evaluation of the tender<\/strong>.\u00a0Those illegalities, by themselves, <strong>justified the annulment of the decision<\/strong> <strong>rejecting the tender<\/strong>.<\/p>\n<p>Finally, the <strong>General Court upheld the claim for damages<\/strong> brought by European Dynamics and others inasmuch as it concerned the compensation for loss of opportunity<\/p>\n<p>The <strong>EUIPO appealed<\/strong> this decision to the ECJ.<\/p>\n<p><span style=\"font-size: 14pt;\"><strong>About the ECJ&#8217;s decision<\/strong><\/span><\/p>\n<p>The <strong>ECJ upheld the EUIPO&#8217;s claim<\/strong> and set aside this part of the judgment.\u00a0In the first part of the second ground of appeal, the EUIPO considered that the mere fact that it <strong>had allegedly made<\/strong> <strong>errors<\/strong> of assessment concerning several sub-criteria of technical award <strong>cannot in itself be considered as a sufficient reason to annul the decision rejecting the tender<\/strong>.\u00a0As the General Court did not examine whether those other comments were sufficient to justify the score given by the contracting authority for the award criterion concerned, it was a sufficient reason to appeal its judgment.<\/p>\n<p>[&#8230;]<\/p>\n<p>The ECJ considered that the <strong>General Court had not established the existence of such a causal link<\/strong> to the requisite legal standard.
