Anne Cousin will speak at the 15th DPO University, organized by the AFCDP, the must-attend event for professionals in GDPR compliance and the French Data Protection Act (“Informatique et Libertés”).

On January 26, 2021, the traditional plenary session and three workshops will take place in a fully remote format.

The other 24 workshops will be held under the same conditions in monthly sessions of three workshops from February to November 2021 (with a break in July and August).

=> On March 26, 2021, Anne Cousin’s presentation will focus on “Repairing harm caused by GDPR violations”:

Compensation for harm resulting from GDPR violations is a major issue for companies. It raises many questions. For data controllers, CNIL fines are a financial loss for which they seek compensation from their processor. Is this position defensible?

Negotiators are calling for a specific cap to limit damages caused by GDPR violations. Is this appropriate?

The issue of recourse between co-perpetrators of harm is also central.

The GDPR provides for a system of joint and several liability. What, then, is the situation of joint controllers who jointly determine the purposes and means of processing? Can they avoid this joint liability, and if so, how?

What recourse is available to the party who has compensated the full extent of the damage, and how can the contract regulate this?
